Terms of Use
Last updated: [date you publish]
These terms cover your use of the Ecom Incubator page at ecomtornado.com and any application you send through it. They are not the contract for the program. If you join, you sign a separate written agreement, and that agreement covers the program.
Please read these terms before you apply. By using this page or sending an application, you agree to them. If you don't agree, please don't apply.
Nothing in these terms takes away rights you have under Indian law, including the Consumer Protection Act, 2019.
The short version
- Applying is free. It doesn't commit you or us to anything.
- You can only join through a written agreement and an invoice from us. The price, GST, payment terms and refund terms are confirmed in writing before you pay.
- Prices: Indian Ecom is Rs 3,00,000 plus 18% GST (Rs 3,54,000 in total). US Ecom is Rs 4,00,000 plus 18% GST (Rs 4,72,000 in total).
- Ad spend, inventory and tools are not included. You pay for them from your own budget.
- Ecom Incubator is education and mentorship. We don't guarantee income, sales or any other result. Many ecommerce businesses lose money.
- Client stories on the page are individual experiences, not typical results.
- You must be 18 or older to apply.
- Refunds: see our Refund Policy.
The full terms are below. If the short version and the full terms differ, the full terms apply.
1. Who we are
This page is run by [Legal business name], trading as "Ecom Tornado" ("we", "us", "our"). Ecom Incubator is our mentorship program, delivered by Nick Arora and his team. Our address, GSTIN and contact details, including our Grievance Officer, are in section 15.
"You" means the person using this page or applying.
2. Using this page
- The page gives general information about Ecom Incubator. It isn't legal, tax, accounting or investment advice.
- We try to keep it accurate and up to date. Prices, tracks and availability can change for future applicants. Your written agreement sets out the final terms for you.
- We may change, pause or remove the page at any time. We don't promise it will always be available or free of errors.
- Fonts on the page load from Google. Videos load from YouTube only when you tap one. See section 10 and our Privacy Policy.
3. Applying
Who can apply
You must be 18 or older. Apply only for yourself, using your own name and contact details. If you share details about a business, you confirm you're allowed to share them with us. If we learn that an applicant is under 18, we won't take the application further and we will delete it.
What you tell us
Please give honest, accurate answers. We use them to decide whether the program could fit you and to prepare for a call. Each application gets an automatic priority score based on the answers. It helps our team decide whom to contact first.
Our Privacy Policy explains what we collect, how the scoring works, where your details are stored and how long we keep them. They are stored with Google and Slack, which may store data outside India. To see, correct or delete your details, withdraw your consent or raise a complaint, email nick@ecomtornado.com.
An application is not an offer or a contract
- Sending an application doesn't create a contract, a booking or a place in the program. It doesn't oblige you to join.
- If your application looks like a fit, Nick or someone from our team will contact you by WhatsApp, phone or email to set up a call.
- If it isn't a fit right now, we'll tell you. We may decline any application, and we don't have to give a reason.
- A call with us is not an offer either. You don't have to decide anything on the call.
- Your place, price and terms are only fixed once they are in a written agreement we have both accepted. If something we said on a call or in a message matters to you, ask us to put it in that agreement.
Contacting you
The consent box on the form is required. When you tick it, you agree that Ecom Tornado can call, WhatsApp or email you about your application. You can withdraw this anytime by emailing nick@ecomtornado.com. If you withdraw it, we'll stop contacting you about your application, so we won't be able to take it further.
WhatsApp tips and updates are separate and optional. You only get them if you ticked that box. You can reply STOP anytime to opt out, or email us.
4. How enrolment works
You are only enrolled when all of these have happened:
- we have offered you a place on a specific track;
- we have sent you a written agreement with the enrolment terms, and you have accepted it;
- we have sent you an invoice; and
- you have made the payment the agreement requires to start.
Take your time to read the written agreement before you sign or pay. The price, GST, payment terms, start date, and refund and cancellation terms are all confirmed in writing before you pay.
If the price for your track has changed since you applied, we will point this out in writing before you sign or pay. If your written agreement differs from this page or these terms, the written agreement applies to the program. It can't take away your rights under Indian law.
Paying safely
Only pay against an invoice from us, using the payment details on that invoice. We accept: [Payment methods you accept, e.g. bank transfer (NEFT/RTGS/IMPS) and UPI].
Someone may ask you to pay without a written agreement and invoice, or contact you claiming to be from Ecom Tornado and ask for money some other way. If that happens, email nick@ecomtornado.com to check before you pay. Never share an OTP, UPI PIN or password with anyone.
5. The program in brief
Ecom Incubator is a 12-month, 1-on-1 ecommerce mentorship with Nick Arora and his team. There are two tracks:
- Indian Ecom: Rs 3,00,000 plus 18% GST (Rs 3,54,000 in total).
- US Ecom: Rs 4,00,000 plus 18% GST (Rs 4,72,000 in total).
If the GST rate changes, your invoice uses the rate in force when it's issued. We may change prices for future applicants. The price in your written agreement is the price you pay.
Payment options: [Choose: A. Full payment before the program starts only / B. Instalments available, with the schedule set out in your written agreement]
What's not included
- Ad spend, for example on Meta or Google ads.
- Inventory (your stock) and any other costs of running your store.
- Tools, apps and subscriptions, such as your Shopify plan and any paid apps.
These come from your own budget, separate from the program fee. Plan your capital for them before you join.
Schedule and who delivers it
Your written agreement sets out the call schedule, the number and length of calls, the support channels, and who delivers each part (Nick or a member of his team). You get it before you pay.
Refunds and cancellation
See our Refund Policy. Your refund and cancellation terms are also confirmed in your written agreement before you pay.
6. No guarantee of income or results
Ecom Incubator is education and mentorship. We don't promise or guarantee any income, sales, profit or other result.
Your results depend on things we don't control. These include your product, your capital, the time and effort you put in, how you act on feedback, your market, competition, platform rules and the wider economy. Many ecommerce businesses lose money, especially at the start. Past record is no guarantee of future prospects.
Your business, your decisions, your risk
- You run your own business and make your own decisions, including how much to spend on ads, stock and tools. Don't spend money you can't afford to lose.
- You are responsible for following the laws and rules that apply to your business. These include tax and GST, consumer protection, product safety and labelling, import and export rules, and the policies of the platforms you use.
- Our mentorship is not legal, tax, accounting or investment advice. Get advice from a qualified professional when you need it.
7. Testimonials and client stories
The client stories and testimonials on the page are individual experiences, not typical results. The page doesn't show average client results. Each outcome depended on that person's own effort, capital, products, market and experience. Your results may be very different, and you may lose money.
[Choose: A. Nobody featured on the page was paid or given anything for their testimonial. / B. Some featured clients received something for sharing their story (e.g. a discount). Say who and what here.]
We won't use your name, photo, story or results as a testimonial without your written permission.
8. Intellectual property
The content of this page and our program materials belong to us or to people who have allowed us to use them. This includes text, videos, images and the Ecom Tornado name and branding.
- You may view the page and share its link for your own, non-commercial use.
- You may not copy, republish or sell our content, or build courses from it, without our written permission. You may not remove any copyright notice.
- If you join, your written agreement explains how you may use program materials. Unless it says otherwise, they are for your own business only. You may not share, resell or publish them, or share your access with anyone else.
What you send us stays yours. We use your application answers only as described in our Privacy Policy.
9. Acceptable conduct
When you use the page or deal with our team, please don't:
- give false information, or apply in someone else's name or with someone else's contact details;
- apply if you are under 18;
- send spam or automated submissions, or try to get around the form's anti-spam checks;
- try to hack, overload, scrape or interfere with the page, the form or the systems behind them;
- send anything unlawful or abusive, or anything that infringes someone else's rights;
- harass, threaten or abuse anyone on our team; or
- copy or misuse our content as described in section 8.
If an application looks like spam or breaks these rules, we may flag it, decline it or not reply. We may stop dealing with anyone who breaks these rules.
10. Third-party platforms and links
Ecom Tornado is not affiliated with, endorsed by or sponsored by Shopify, Meta, Google or YouTube. We mention them only to describe the platforms we teach about. Their names and brands belong to their owners.
- Your accounts on these platforms are between you and them, and their terms and policies apply. They can change their rules, fees or features, reject ads, or restrict or suspend accounts. We don't control this and aren't responsible for their decisions.
- This page loads fonts from Google. Videos play through YouTube and load only when you tap one. Their own terms and privacy policies apply. Our Privacy Policy has the details.
- Links to other websites are there for convenience. We don't control those sites and aren't responsible for their content.
- [Choose: A. We don't earn any commission or fee from tools, apps or suppliers we recommend. / B. We may earn a commission from some tools, apps or suppliers we recommend, and we will tell you when we do.]
11. Limitation of liability
Nothing in these terms excludes or limits any liability that can't be excluded or limited under Indian law. This includes your rights under the Consumer Protection Act, 2019, and our liability for fraud or misrepresentation.
Subject to that:
- We provide this page as it is, for general information.
- We are not responsible for losses that come from your own business decisions, such as money you spend on ads, inventory or tools.
- We are not responsible for what third-party platforms such as Shopify, Meta, Google or YouTube decide or do.
- We are not responsible for losses that we could not reasonably have foreseen when you used the page or applied.
- For anything relating to this page or your application, our total liability to you is limited to [Choose: A. Rs [amount, e.g. 5,000] / B. No fixed cap: delete this line].
- If you enrol, the liability terms in your written agreement apply to the program, within the limits of Indian law.
If you break these terms
Say you break these terms, for example by giving false information or misusing our content, and that directly causes us a loss. You may then have to make good that loss, to the extent the law allows.
12. Changes to these terms
We may update these terms, for example when the program, the page or the law changes. We will post the new version on this page with a new "Last updated" date. Changes apply from that date. They don't apply to anything that happened before it. They don't change a written agreement you have already accepted with us.
13. Governing law and disputes
These terms are governed by the laws of India. Subject to the next paragraph, the courts at [city] have jurisdiction over any dispute about them.
This doesn't take away your right to file a consumer complaint wherever the Consumer Protection Act, 2019 allows, including where you live or work.
If you have a problem, please tell us or our Grievance Officer (section 15) so we can try to fix it. You can also contact the National Consumer Helpline at any time: call 1915 or visit consumerhelpline.gov.in.
14. Other legal points
- If any part of these terms is found invalid, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- These terms, our Privacy Policy and our Refund Policy together set out the terms between us about this page and your application. If you join, your written agreement covers the program.
- You can't transfer your application, or your rights under these terms, to anyone else.
